FULL DESCRIPTION OF WHAT HAPPENED IN YOUR OWN WORDS:
On April 14 I was heading west on Irving Street.
I was at the intersection at 9th Avenue and Irving Street waiting my
red light to turn green. Next to me was a SFPD patrol car with two
officers inside. We were both heading west on Irving.
As the light turned green I proceeded through the intersection. A
woman in a tan Oldsmobile going southbound on 9th Avenue was making a
waiting to make a left turn onto Irving Street. While the woman's
vehicle was in the crosswalk, the light turned red.
As I was proceeding through the intersection I made eye contact with
her wondering if she saw me and going was going to stop. As I passed
through the intersection, she went ahead and made the left turn
against the red passing the two officers.
Being a cyclist and having numerous close calls with people running
red lights I was frustrated that finally an officer was witnessing a
vehicle pass a red light and do nothing about it.
As the officers were passing me on Irving Street and 11th Avenue. I
said to the officer in the passenger seat, "Didn't you see the woman
go through the red light?" After making this comment I continued
cycling toward my home.
The officers then slowed waiting for me to pull along side of
them. The officer in the passenger seat asked for me to repeat myself.
When I said that the woman had gone through the red light and they
didn't do anything about it, he said, "Could you please stop I want to
have a talk with you."
After being stopped at Irving Street and 12th Avenue, the officer
asked me to get off my bike.
I asked him why I was being stopped. He replied, "You went through a
red light".
I replied that the woman went through the red light. The officer
replied, "She was already in the intersection and needed to get
through the intersection."
I said, "That proves that the my light was green. In addition, the
traffic heading east on Irving had already starting entering the
intersection heading east".
I kept telling the officer, I travel by bike and do not run red lights
for fear of getting hit. I would be crazy to ride into oncoming
traffic, especially at a busy intersection as 9th Avenue and Irving
Street. In addition to looking out for my safety, a police car
sitting next to me.
The officer from that point on kept saying "Tell it to the judge..."
The officer then wrote me a citation for running a red light which I
clearly did not do.
Complaint filed? I am in the process of filling a complaint.
